Barrister Gohar Ali Joins JCP Following Ayub’s Resignation

ISLAMABAD: Barrister Gohar Ali Khan, chairman of Pakistan Tehreek-e-Insaf (PTI), has been appointed as a member of the Judicial Commission of Pakistan (JCP). His nomination, put forth by Opposition Leader in the National Assembly Omar Ayub, received approval from Chief Justice of Pakistan (CJP) Yahya Afridi, according to a notification issued on Thursday.

Barrister Gohar Ali assumes the role after Omar Ayub stepped down from the position. Similarly, Senator Barrister Ali Zafar was recently appointed to the commission following the resignation of Senator Shibli Faraz.

Resignations Amid Legal Challenges

Both Ayub and Faraz cited legal pressures as their reason for stepping down, pointing to multiple cases filed against them after PTI’s Islamabad protests turned violent. The resignations come amid a series of challenges faced by PTI leaders, with allegations and FIRs complicating their ability to fulfill official responsibilities.

In his resignation, Faraz described the position as a deeply significant and challenging role, integral to improving the judicial system and ensuring justice. However, he noted that the influx of what he described as “false cases” had made it impossible for him to devote the necessary focus and attention. Ayub echoed similar sentiments, expressing confidence in Barrister Gohar’s ability to uphold the commission’s principles with integrity and dedication.

JCP’s Role and Structure

The Judicial Commission of Pakistan, chaired by the chief justice, comprises senators, MNAs, the three senior-most Supreme Court judges, the most senior judge of the constitutional bench, the federal law minister, the attorney general, and a senior advocate nominated by the Pakistan Bar Council. Its primary responsibilities include appointing judges to the Supreme Court, high courts, and Federal Shariat Court, as well as evaluating the performance of high court judges.

The recent reconstitution of the JCP followed the enactment of the 26th Constitutional Amendment. As part of this process, Faraz and Ayub were initially nominated alongside other lawmakers from both houses of Parliament.

Looking Ahead

Barrister Gohar’s legal expertise and commitment are expected to bring value to the commission, which plays a critical role in strengthening Pakistan’s judiciary. His appointment comes at a pivotal time as the JCP continues its mandate to uphold justice and ensure the effective functioning of the country’s judicial system.
