The Islamabad High Court (IHC) on Tuesday ruled that the fake degree petition filed against Justice Tariq Mehmood Jahangiri is admissible for hearing.
A division bench led by Chief Justice Sardar Muhammad Sarfraz Dogar and Justice Azam Khan issued notices to Justice Jahangiri and all concerned parties, directing them to file their responses within three days.
During the proceedings, amicus curiae Barrister Zafarullah Khan supported the petition’s maintainability, while the Islamabad District Bar opposed it.
Petitioner Mian Dawood argued that Karachi University’s verification confirmed the judge’s degree as fake and maintained that the IHC could hear a petition against one of its own judges.
In response, Islamabad Bar lawyer Ahmed Hassan contended that the petitioner lacked standing in the matter.
Chief Justice Dogar noted that issues of misconduct and eligibility for judicial office were separate considerations. Hassan further pointed out that an intra-court appeal regarding judges’ transfers was already pending and requested that the chief justice refrain from hearing this case.
Islamabad Bar Council member Raja Aleem Abbasi also urged transferring the matter to another bench, citing a Sindh High Court stay order.
Barrister Zafarullah Khan once again endorsed the case’s admissibility.
The bench ultimately declared the petition maintainable and issued notices to Justice Jahangiri, the federal government, the President, the Secretary of the Judicial Commission, the Parliamentary Committee on Judicial Appointments, the Higher Education Commission (HEC), and Karachi University.
All parties have been ordered to submit their replies within three days.
